|
Appointed by Council and available on a limited basis, a Judge Pro-Tem is responsible for applying relevant Supreme Court Rules, state statues, City ordinances, and case law when presiding over trials to the court, trials to a jury, pre-trial conferences, arraignments, motions, and other hearings. A Judge Pro-Tem is also responsible for imposing sentences commensurate to the offense and within the parameters allowed by law. In addition, a Judge Pro-Tem determines the conditions, which, if met, will allow the defendant’s release from police custody. |

Essential Functions:
|
In absence of the Presiding Judge, the Pro-Tem Judge: - Presides over a variety of hearings, including criminal misdemeanors, traffic, criminal and civil arraignments, jury and non-jury trials, pre-trial conferences and civil hearings
- Presides over arraignments, pretrial disposition conferences, calendar calls, probation violation hearings, jury, and nonjury trials
- Hears and rules on motions
- Imposes sentencing after a finding of guilty or responsible in a jury or non-jury trial
- Reviews, signs or rejects search warrants, review, issue and sign complaints/subpoenas and FTA/ FTP warrants, verify and review materials for the highest level of quality and accuracy
- Conducts hearings for orders of protection and harassment injunctions, and prepare appropriate orders
- Researches legal issues and prepare legal opinions; interprets City, State and Federal laws, ordinances, statutes and court decisions; analyzes evidence and data presented in court and applies existing law in the rendering of fair and equitable judgments
- Presides over pleas, motions, and sentencing issues and also decides extended time payments, restitution, revocation or probation and bond forfeiture hearings; demonstrates the ability to listen and communicate effectively, both orally and in written form
- Performs other duties of a similar nature or level

Qualifications:
|
| Juris Doctorate and minimum five years as a practicing attorney. Bilingual (Spanish) desired. |
