Under policy directive of the Board of Supervisors performs highly responsible professional and administrative legal work as legal advisor to the Board of Supervisors, county government and its officers and employees, and to school districts and other special districts, and performs administrative work in organizing, coordinating and directing the activities of the Office of County Counsel.

Typical Management Responsibilities
Establishes and maintains appropriate administrative policies, services, controls and reporting systems in the effective and efficient performance of office functions.
Maintains close liaison with the Board of Supervisors as to all legal matters relating to or affecting Board of Supervisors' policies.
Establishes and maintains goals, objectives and plans for carrying out the functions of the office consistent with Board of Supervisors' policy determinations.
Organizes, coordinates, supervises and directs the activities of the Office of County Counsel.
Coordinates office activities with other agencies and appropriate community organizations.
Appoints, trains, supervises, evaluates and directs subordinates and professional, administrative and clerical staff.
Recommends the annual office budget to the County Executive and participates in its presentation to the Board of Supervisors.
Directs maintenance of office fiscal and personnel records and performs related work.
Legal Responsibilities
Defends or prosecutes, as legally required, all civil actions and proceedings in which the county or any of its offices are involved, excepting those matters as to which the county is insured.
Provides legal leadership, subject to policy direction of the Board of Supervisors, to county government.
Advises county boards and commissions and departments through oral or written opinions and drafts legal documents and ordinances.
Represents upon request superior and municipal court judges and special districts.
Acts as attorney for school districts, the public administrator, public guardian, Lanterman-Petris-Short (LPS) proceedings and the Santa Clara County Transit District.
Performs other professional legal services as mandated by law.
Studies, interprets and applies constitutions, statutes, ordinances, court decisions and legal opinions in connection with legal advice, suits, trials, hearings, appeals and similar legal proceedings and makes decisions, subject to Board of Supervisors' policies, to prosecute, compromise or dismiss civil litigation. |

Employment Standards:
|
Membership in the California State Bar.
Six years of experience in professional legal work, including or supplemented by three years of practice in civil law, and including experience in organizing, coordinating and directing the administration of a professional, administrative and clerical staff.
Knowledge of:
Principles of civil, constitutional and administrative law, particularly as it relates to county government, and other public agency law.
Responsibilities, powers and statutory limitations of the Office of County Counsel.
Judicial proceedings at the administrative, trial and appellate levels and Rules of Evidence.
Principles, methods, materials and practices of legal research.
Management techniques and skills applicable to a professional law office.
Ability to:
Analyze, appraise and organize facts, evidence and precedents and to present such materials orally or in clear, written and legal form.
Analyze and appraise a variety of legal documents and instruments.
Draft legal instruments such as ordinances, resolutions, Board orders and contracts.
Establish and maintain effective management relationships with county and court officials and the general public.
Supervise and coordinate the work of professional, administrative and clerical subordinates engaged in work of a legal nature.
Work successfully with diverse persons and interests both in government and with the public in general. |
